This website tells you who we are and what we make. Reading it is free, nothing here is a contract for anything, and these terms cover the site alone.
Topiary is a product you sign into, and it carries its own terms at usetopiary.app/terms. Those govern your use of the app. Nothing on this page adds to them, limits them or replaces them.
What this site is
An account of the studio and the software it publishes. The pages here are informational. They are not an offer to enter a contract, not professional advice of any kind, and not a commitment to build or release anything described on them.
Products described here
Each product we publish carries its own terms and its own privacy policy, and those apply when you use it. For Topiary they are at usetopiary.app/terms and usetopiary.app/privacy. Where anything on this site disagrees with a product's own terms, the product's terms are the ones that count.
Statements about what is coming
We say on the home page that more products are in the pipeline, and descriptions of work that is unreleased or in testing are statements of present intention rather than promises. Plans change, features are cut, and release dates move. Please do not make a decision that matters to you on the strength of something here that we have not yet shipped.
Accuracy and availability
We keep this site accurate and current as best we can, and we may change or remove anything on it without notice. We do not undertake that it will always be reachable or free of error, and it may be unavailable while it is being maintained or if our host has a problem.
The ZentoMirai name and mark
The text, images, layout, the ZentoMirai name and the seal used as our logo belong to us or are used with permission, and copying or reusing them as your own is not permitted. You are welcome to link to this site, and to use our name to refer to us in writing about us, which is what a name is for. Please do not use the seal or the name in a way that suggests we endorse, supply or are connected with something we are not.
Acceptable use
Read the site, link to it, quote it fairly. Do not attempt to interfere with it, gain access to any part of it that is not published, overload it with automated requests, or use it to do anything unlawful.
Liability
To the extent the law allows, this site is provided as it stands and without warranties, and Zento Mirai is not liable for indirect or consequential loss, lost profits, or loss arising from reliance on information published here.
Nothing in these terms removes consumer rights you have under the law where you live, including, in New Zealand, guarantees that cannot be contracted out of for consumers under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
Changes to these terms
If we change these terms we will update this page and the date at the top of it in the same edit. Continuing to use the site afterwards means you accept the version then published.
Governing law
These terms are governed by the laws of New Zealand, and its courts have jurisdiction over any dispute, without affecting any right you have to bring a claim where you live.
